In the event of violation of EU law by a member state, the European Commission has the right to initiate a procedure against such a country under Article 258 of the Treaty on the Functioning of the European Union (TFEU).
The average time between a TFEU judgment and adherence to the judgment was 30.4 months. For small businesses it is a very long period of waiting if the case is about to pay, it may end with the bankruptcy of such a company, they may be protectionist measures of an EU country to protect their market or unfair competition using domestic law to take over business ideas or protect their own businessmen etc. The examples could be multiplied but this is one in my opinion a very important signal for all of us who use populists in their election campaign, accusing Brussels of abusing and favoring richer and larger countries,of course, it is used not only by internal populist parties, but also by people hostile to democracy from outside the EU.
In my opinion, it would be necessary to work on streamlining the process – it is about time, it’s being shortened to the minimum for interested parties. The small business gives employment to the largest number of employees, that’s why I think this is important.
